Preamble

The present General Terms and Conditions of Sale (GTCS) apply, without restriction or reserve, to all sales concluded between the company Black Eyes, a subsidiary of Be Consult LTD, and any consumer or professional wishing to make a purchase via the official website of the Besmooth brand(https://besmooth.fr), whose trademark is registered with the INPI.

Besmooth brand management, distribution and customer service are handled exclusively by the Black Eyes team.

Our French subsidiary, operating under the same commercial identity, is located at 198 Avenue de France, 75013 Paris.

Article 1 – Acceptance of the Conditions

By validating his order, the customer acknowledges having read these GTC and accepts them without reservation. No particular condition can, except formal and written acceptance of Black Eyes, prevail against these GCS.

Article 2 – Products

The products offered for sale are those listed on the official Besmooth brand website(https://besmooth.fr). They are described and presented as accurately as possible. Black Eyes cannot be held responsible for any insubstantial difference between the photos and the products.

Article 3 – Prices

Product prices are quoted in euros, inclusive of all taxes. Black Eyes reserves the right to modify prices at any time, but products will be invoiced on the basis of the rates in effect at the time the order is registered.

Article 4 – Ordering

The customer places an order online from the catalog available on the https://besmooth.fr website . Validation of the order implies acceptance of the prices and product descriptions. A confirmation email is sent automatically.

Article 5 – Payment

Payment is due immediately upon ordering. Payment is made by credit card, PayPal or any other secure method offered on the platform. Any attempt at fraud will result in immediate cancellation of the order.

Article 6 – Delivery

See the “Delivery” page for details. In case of delay, an email is sent to the customer. If the product has not been delivered after 30 days, the customer may request a cancellation and refund.

Article 7 – Right of withdrawal

See the “Returns & Refunds” page for detailed conditions. The right of withdrawal is subject to strict conditions to guarantee product hygiene and safety.

Article 8 – Liability

Black Eyes shall not be held liable for any damage resulting from misuse of the product purchased. The liability of the company is in any case limited to the amount of the order.

Article 9 – Intellectual property

All elements of the Besmooth website(https://besmooth.fr) are protected by intellectual property laws. Any unauthorized reproduction, distribution or use is strictly prohibited.

The Besmooth brand and its graphic, textual and audiovisual elements are the exclusive property of Black Eyes.
